Refund and Cancellation Policy

1. Introduction

This Refund and Cancellation Policy explains how ASD subscription cancellations, refund requests, campaign-related cancellations, and payment issues may be handled.

ASD is planned as a subscription-based platform. Users may subscribe for access to member features, campaign visibility, claim functionality, and other platform services according to ASD rules.

This policy is prepared as a draft structure and should be reviewed by a qualified Cyprus/EU lawyer before publication, launch, or commercial use.

2. Subscription cancellation

Users may cancel their ASD subscription through the cancellation method provided by ASD or the relevant payment provider.

When a user cancels a subscription, the cancellation stops future renewal charges.

Cancellation does not automatically remove access immediately. The user’s subscription will normally remain valid until the end of the already-paid subscription period.

For example, if a user pays for a monthly subscription and cancels halfway through the month, the subscription access may remain active until the end of that paid month.

3. Access after cancellation

After cancellation, the user may continue to access paid ASD member features until the end of the current paid billing period, unless ASD restricts the account due to breach of rules, fraud, misuse, chargeback, legal risk, or another serious issue.

Once the paid period ends, the subscription will not renew and the user may lose access to paid member features, claim functionality, or other subscription-only services.

Cancellation may affect the user’s eligibility for future campaign claims after the paid period ends.

4. Refund position

ASD does not intend to make refunds automatic or easy unless a refund is required by applicable law or ASD approves a refund in exceptional circumstances.

Subscription fees are generally paid for access to the ASD platform during the relevant billing period.

If a user cancels after payment, the user will normally keep access until the end of the paid period instead of receiving a refund for the unused part of that period.

ASD may refuse refund requests where the user has already received platform access, used member features, accessed campaign functionality, submitted claims, or benefited from the subscription service.

5. Legal refund rights

Nothing in this policy is intended to remove any mandatory consumer rights that apply under Cyprus or EU law.

If applicable law requires ASD to provide a refund, withdrawal right, remedy, cancellation right, or other consumer protection, ASD will comply with the law.

The exact legal refund and withdrawal wording should be reviewed by a qualified Cyprus/EU lawyer before launch, especially if ASD provides digital services, immediate access, subscriptions, campaign claims, or paid member functionality.

6. Cooling-off and withdrawal rights

Depending on applicable consumer law, users may have a statutory right to withdraw from certain online contracts within a cooling-off period.

The application of withdrawal rights to ASD subscriptions, digital services, immediate access, campaign functionality, and used services should be reviewed by ASD’s legal advisor.

ASD should clearly explain at checkout whether the user is requesting immediate access and how that may affect withdrawal or refund rights under applicable law.

This section must be finalised by a qualified Cyprus/EU lawyer before launch.

7. No refund for unsuccessful claims

ASD subscription payments do not guarantee that a user will successfully claim a campaign.

A failed, rejected, released, or unsuccessful campaign claim does not automatically create a right to a subscription refund.

Campaign claims remain subject to ASD review, profile completion, eligibility checks, campaign availability, seller or supplier confirmation, legal requirements, payment requirements, and final ASD approval.

Users subscribe for platform access, not for a guaranteed product purchase, property purchase, delivery, or claim outcome.

8. No refund because a campaign is unavailable

Campaign availability may change due to seller withdrawal, supplier issues, stock changes, property availability, legal concerns, pricing corrections, technical issues, or operational reasons.

If a campaign becomes unavailable, this does not automatically create a right to a subscription refund.

ASD may update, replace, remove, pause, or cancel campaigns according to the Campaign Rules and platform requirements.

9. Duplicate payments

If a user believes they were charged twice for the same billing period, they should contact ASD with proof of payment and account details.

ASD may review the payment history with the payment provider.

If ASD confirms a duplicate payment error, ASD may issue a refund or credit where appropriate.

10. Payment errors

If a payment error occurs, ASD may investigate the issue with the relevant payment provider.

A payment error may include incorrect billing, technical payment failure, duplicate charge, failed payment, or payment provider issue.

ASD may require proof of payment, bank confirmation, transaction reference, account email, and other information before reviewing the request.

11. Chargebacks and disputes

If a user opens a chargeback or payment dispute, ASD may suspend the user’s subscription, restrict account access, pause any active claim, or request further information.

False, abusive, or repeated chargebacks may lead to account restriction or termination.

ASD may provide transaction records, subscription records, account activity, claim activity, and communication history to the payment provider where needed to respond to a dispute.

12. Campaign purchase cancellation

A subscription cancellation is different from cancelling a campaign purchase or claim.

If a product or property campaign reaches a later purchase stage, cancellation rules may depend on the campaign type, seller, supplier, product status, delivery status, property transaction status, signed agreements, payment status, legal requirements, and applicable law.

Campaign purchase cancellation rules should be reviewed separately under the Terms and Conditions, Campaign Rules, Claim and Purchase Disclaimer, and any campaign-specific agreement.

13. Product-related refunds

Product-related refunds may depend on the product type, supplier policy, seller policy, delivery status, product condition, legal consumer rights, and whether the product has been used, damaged, customised, installed, or delivered.

The ASD subscription fee is separate from any product purchase amount.

A product issue does not automatically create a right to a subscription refund, unless required by applicable law or approved by ASD.

14. Property-related refunds

Property campaign payments, deposits, reservation amounts, legal fees, transfer fees, taxes, or other property-related costs may be subject to separate rules, agreements, seller terms, lawyer instructions, and applicable law.

A property claim does not automatically create a property sale or transfer.

Property-related refund rules must be confirmed in the relevant sale agreement, reservation agreement, legal documents, and professional advice.

The ASD subscription fee is separate from property purchase costs and property transfer costs.

15. Delivery cost refunds

Delivery costs are normally covered by the buyer unless ASD clearly states otherwise in writing.

Refunds of delivery costs may depend on whether delivery was attempted, completed, failed due to buyer fault, cancelled by the buyer, cancelled by the seller, or affected by courier issues.

Delivery cost refund rules should be confirmed before the buyer proceeds with delivery arrangements.

16. Account termination by ASD

ASD may suspend or terminate an account if the user breaches platform rules, misuses the claim system, provides false information, creates duplicate accounts, commits fraud, abuses payment systems, or creates legal or operational risk.

If ASD terminates an account for breach of rules, the user may not be entitled to a refund unless required by applicable law.

Any active claims may be cancelled, rejected, or released if the account is suspended or terminated.

17. How to request cancellation or refund review

Users should follow the cancellation process provided inside their account, dashboard, payment portal, or ASD support process.

For refund review requests, users should contact ASD with their account email, payment date, transaction reference, reason for the request, and any supporting evidence.

ASD may review the request and respond according to this policy, applicable law, payment provider records, and platform rules.

18. Processing time

Refund review times may vary depending on the payment provider, bank, transaction method, evidence required, and complexity of the request.

If ASD approves a refund, the time needed for the amount to appear in the user’s account may depend on the payment provider and bank.

ASD is not responsible for delays caused by banks, card providers, payment processors, or third-party systems.

19. Policy updates

ASD may update this Refund and Cancellation Policy from time to time to reflect changes in subscription features, payment providers, legal requirements, campaign rules, or business operations.

Updated versions may be published on this page with a revised date.
