Claim and Purchase Disclaimer

1. Introduction

This Claim and Purchase Disclaimer explains what happens when a user clicks a claim button on ASD and what the claim does and does not mean.

ASD may display selected property and product campaigns with campaign prices, funding progress, claim availability, and status labels.

This disclaimer is prepared as a draft structure and should be reviewed by a qualified Cyprus/EU lawyer before publication, launch, or commercial use.

2. A claim is not an automatic purchase

Submitting a claim on ASD does not automatically complete a purchase.

A claim does not automatically create a binding sale contract, transfer ownership, confirm delivery, reserve stock permanently, complete a property transaction, or guarantee that the user will receive the campaign item.

A claim only records the user’s interest and may reserve the right to proceed to ASD review, subject to the campaign rules and final checks.

3. A claim is a reservation for review

When a user submits a valid claim, ASD may mark the campaign as Reserved while the claim is reviewed.

Reservation means ASD will review the claim before deciding whether the user can proceed to the next stage.

ASD may review the user profile, subscription status, eligibility status, claim timing, campaign availability, seller confirmation, supplier confirmation, legal requirements, payment requirements, delivery requirements, or property transfer requirements.

4. Profile completion requirement

ASD may require users to complete their profile before submitting a claim.

Required profile details may include full name, username, email address, country of origin, city, and phone number.

For some campaigns, especially property campaigns, ASD may request additional details after the claim is submitted in order to support legal, eligibility, payment, or transfer checks.

5. Subscription does not guarantee a claim

An ASD subscription may provide access to member features and claim functionality, but it does not guarantee that the user will successfully claim a campaign.

A subscription does not guarantee that a campaign will become Ready to claim.

A subscription does not guarantee that a claim will be approved, that a purchase will be completed, that a product will be delivered, or that a property will be transferred.

6. Campaign availability

Campaign availability may change at any time before completion.

A campaign may become unavailable because of stock changes, seller withdrawal, developer withdrawal, property sale, supplier issue, legal issue, payment issue, technical issue, pricing error, campaign correction, or operational decision.

ASD may pause, remove, correct, update, or cancel a campaign where necessary.

7. First valid claim

If several users attempt to claim the same campaign, ASD may rely on the first valid recorded claim according to ASD platform records and technical timestamps.

A claim may not be considered valid if it is incomplete, fraudulent, duplicated, submitted by an ineligible user, submitted by an incomplete profile, or affected by a technical or legal issue.

ASD may review claim timing and validity before confirming next steps.

8. ASD review process

After a claim is submitted, ASD may contact the user using the email address or phone number provided in the member profile.

The user may need to respond within a specified timeframe and provide any additional information required by ASD.

ASD may approve the claim, reject the claim, request more information, place the claim under review, or release the campaign.

ASD may reject or release a claim if the user does not respond, does not complete required steps, is not eligible, provides inaccurate information, fails payment requirements, or breaches platform rules.

9. No automatic price guarantee

Campaign prices shown on ASD are part of the campaign display and funding structure.

A displayed campaign price does not automatically guarantee that the user can purchase the product or property at that price without further checks.

ASD may correct obvious errors, technical errors, calculation errors, data errors, pricing errors, or third-party information errors.

Final pricing, payable amounts, taxes, delivery costs, property transfer costs, and buyer-paid fees should be confirmed before the user proceeds.

10. Product claims

For product campaigns, a successful claim may lead to further checks around product availability, supplier confirmation, payment steps, delivery location, delivery cost, VAT, warranty, and handover process.

A product claim does not automatically mean that the product has been purchased or shipped.

Delivery, installation, customs, taxes, special handling, or other buyer-paid charges may apply unless ASD clearly states otherwise.

Users should review the Delivery and Delivery Costs page and Purchase Taxes and Buyer Fees page before proceeding with any product campaign.

11. Property claims

For property campaigns, a successful claim does not transfer ownership and does not automatically create a property sale contract.

Property purchases may require legal due diligence, identification checks, seller confirmation, contract preparation, tax review, payment arrangements, Land Registry procedures, professional advice, and authority requirements.

The buyer may be responsible for transfer fees, VAT where applicable, stamp duties, Land Registry fees, legal fees, professional fees, bank charges, taxes, and other buyer-side costs unless expressly stated otherwise.

Users should review the Property Transfer Procedures and Costs page before proceeding with any property campaign.

12. Delivery and collection

Some product campaigns may require delivery, collection, courier services, installation, or special handling.

Delivery availability, delivery timing, delivery location, courier responsibility, and delivery cost should be confirmed before completion.

Unless clearly stated otherwise, delivery costs may be paid by the buyer.

ASD may use third-party couriers, sellers, stores, suppliers, or partners to coordinate delivery or collection.

13. Taxes and buyer-paid costs

Campaign prices may not include all taxes, VAT, duties, government charges, legal fees, delivery fees, property transfer costs, professional fees, bank fees, or other buyer-paid charges.

The user is responsible for reviewing all applicable costs before proceeding.

ASD may provide general information, but users should obtain independent legal, tax, financial, or professional advice where needed.

14. Seller, supplier, and partner involvement

Campaigns may involve third-party sellers, suppliers, property developers, agents, stores, couriers, lawyers, accountants, or other partners.

ASD may depend on third-party information, confirmation, availability, documents, pricing, delivery details, property details, or transaction requirements.

ASD is not responsible for third-party delays, errors, refusals, legal restrictions, delivery problems, property transfer issues, or availability changes unless ASD expressly accepts responsibility in writing.

15. User responsibility before claiming

Before submitting a claim, users should review the campaign page, campaign status, campaign price, final campaign price, legal documents, delivery information, tax information, property transfer information, and any visible disclaimers.

Users should not submit a claim unless they understand that the claim is subject to ASD review and does not automatically complete a purchase.

Users are responsible for providing accurate information and responding to ASD requests within the required timeframe.

16. Claim rejection or release

ASD may reject a claim, cancel a reservation, or release a campaign if the user is not eligible, fails to complete required steps, fails to respond, provides false or incomplete information, does not complete payment steps, or breaches ASD rules.

ASD may also reject or release a claim if the campaign becomes unavailable, the seller or supplier cannot proceed, the property cannot proceed, or there is a legal, technical, operational, or pricing issue.

If a claim is released, ASD may reopen the campaign, mark it as Ready to claim, return it to Coming soon, remove it, or take another action according to platform rules.

17. No investment or ownership rights

Using ASD, subscribing to ASD, or claiming a campaign does not create investment rights, ownership rights, equity rights, voting rights, profit rights, or rights in ASD’s subscription pool.

Users do not acquire any right in a campaign item unless and until the required purchase, delivery, transfer, or contractual process has been completed.

For property campaigns, ownership only changes through the required legal property transfer process.

18. Technical issues

ASD may experience technical delays, platform errors, display errors, claim recording issues, payment provider issues, database issues, or hosting interruptions.

ASD may correct technical errors and may review claim records where an error affects campaign status, claim timing, or claim availability.

ASD may pause campaigns or claims while investigating technical issues.

19. Independent advice

Users should seek independent legal, tax, financial, or professional advice before proceeding with significant product or property purchases.

Property campaigns may involve substantial legal and financial obligations, so users should not rely only on ASD campaign information before proceeding.

ASD may coordinate information, but it does not replace independent professional advice.
